The Military Courts Martial System is an imposing, and sometimes harsh judicial system. With very few cases prosecuted each year by the Military Courts Martial system, all efforts are put into every case.

The Uniform Code of Military Justice provides many of the same safeguards as our civilian system, but with a few major differences.  Instead of law enforcement bringing the charges, the UCMJ is generally a command driven complaint system. The Commander brings the charges against a soldier, sailor, or airman, and the prosecutors prosecute the violations of the Code.

The biggest difference between the civilian system and the Military system of justice, lies in the jury box. A jury of peers in the Military may consist of a few Colonels and a few Chief Master Sergeants. If it happens to be a defendant’s first or second year in the service, that jury does not resemble anyone with whom the Defendant has ever had a conversation (i.e. his or her “peers”).
